Last month, CMS issued version 4 of the MMSEA Section 111 User Guide. The purpose of the Guide is to provide Responsible Reporting Entities (RREs) with necessary guidance to comply with Medicare Secondary Payer data reporting rules that have been in force for some time. As a refresher, RREs were required to begin reporting Ongoing Responsibility for Medicals as of January 1, 2011 on claims that were open as of January 1, 2010. Total Payment to Claimant Obligations (or settlements, judgments and awards) began reporting on January 1, 2011, for claims that resolved as of 10/1/2010. Thresholds were imposed to limit reporting and as of 10/1/2013, any claim settlement, judgment or award over $2,000 must now reported. Next October, unless SMART implementation changes it, the threshold is set at over $300.
