We had previously blogged regarding CMS issuing a Request for Proposal (RFP) for a new WCRC contractor to review Workers’ Compensation Medicare Set-Aside (WCMSA) proposals. For our prior blogs on this anticipated award, click here.
Just yesterday, CMS has now stated that its anticipated proposal date will now be October 24, 2016 with an anticipated award date of February 8, 2016 (the updated RFP states the year 2016, however we anticipate that this was a scrivener error and that the intended year is 2017). The prior award date was to be November 7, 2016; therefore this alert from CMS indicates they are delaying the award by 3 months. For a link to the updated RFP, please click here.
As we had previously blogged, CMS has indicated that the new WCRC’s Statement of Work (SOW) would include the review of liability Medicare Set-Aside (LMSA) proposals, something that CMS/WCRC has never previously formally engaged in. There is no indication from this modified RFP that this would change.
A change in contractors reviewing WCMSAs and potentially LMSAs early next year is something to watch. While the contractor will drive CMS’ formal policy, a variance in views and an initial learning curve by a new contractor could impact current processes and procedures. We will continue to provide updates on the WCRC as they arise.
